Cannot be off-duty, and non-citizens count (obviously). In-custody deaths do not count for this, this is only counting on-duty killings. This is regardless of circumstances involved, such as an individual attacking an officer.
RESOLVED. There was a killing in the streets this morning in Minneapolis by ICE agents.

@Valerie I am in total agreement with you now. I'm convinced he was disarmed before the first shot was even fired. His gun was taken off of him before the first shot -- it does not look like it was even brandished.

@MachiNi I am trying to confirm that the first shot in my count wasn't by the victim. There appears to be rumors that the victim was armed, but I strongly distrust the source of this information, so take it with a grain of salt.
In the video of the event, an agent on the left side of the video unholsters their weapon after the victim had already fallen and begins firing at about the 17 or 18 second mark. I counted 5 shots from that agent alone.
The Department of Homeland Security said the man was armed with a gun.
