The Daily did a really interesting overview of this case. A lot of potential payout recipients don’t want the deal dropped as this is their only guaranteed payout route.

Were this case to be dropped, it’s something of a “first to sue” race, where the first people getting paid out by the Sacklers will be the richest, and this process alone will make it harder for subsequent cases to get hefty payouts.

Though this may not be a valid use of the bankruptcy system, and the Sacklers are walking away with their bloody billions, this sadly may be the best course forward for all.

Lots of conjecture, but I don’t necessarily see this case being compelling enough to overrule the deal.

@mattyb I basically agree with that logic, but if you are SCOTUS and you think that, i think you are much better off denying cert. Because ex ante, the availability of this scheme is terrible incentives. And writing a Supreme Court opinion saying this is OK to do is much worse than doing nothing. And i do think they will have a hard time doing that.
