Background
Brown v. United States and Jackson v. United States are consolidated cases involving the Armed Career Criminal Act (ACCA). The Court was asked to determine whether the definition of a serious drug offense in the Armed Career Criminal Act 18 U.S.C. § 924(e)(2)(A)(ii), includes the federal drug schedules that were in effect at the time of the federal firearm offense. The Court is also asked which version of federal law a sentencing court should consult when applying the ACCA's categorical approach.
