Resolves YES if an increase to the top marginal tax rate on long term capital gains (currently 20%) for US federal taxes is enacted into law in 2025, otherwise NO.
The tax raise does not have to be effective at this time, as long as it is enacted into law. The net investment income tax will have no bearing on the resolution of this question.
