With Elizondo soon testifying under oath before Congress, he'll finally have the chance to officially support his claims. If any of his statements are found to be false, this could open the door to potential perjury charges. This hearing could be a pivotal moment in assessing the credibility of his disclosures.
The charges you mention couldn’t be proved in open court because it would require proving beyond a reasonable doubt that the things he is talking about don’t exist. He might get charged for violating his NDA though and that should be easy to prove. His claims are regularly verified indirectly at the highest levels such as the DNI and head of NASA.
