Title II of the US Civil Rights Act of 1964 states that "All persons shall be entitled to the full and equal enjoyment of the goods, services, facilities, privileges, advantages, and accommodations of any place of public accommodation, as defined in this section, without discrimination or segregation on the ground of race, color, religion, or national origin."

Some have suggested that the Supreme Court may be interested in overturning this section, and legalizing discrimination on the ground of race, color, religion, or national origin.

This market will resolve to YES if Title II is overturned, in whole or in part, by the end of their current term (Oct 2023). This market will also resolve to YES if Title II is modified by the legislature. This market will only resolve to NO if Title II remains unchanged and in force.

I think this resolves yes because colleges still discriminate on the basis of race.

"Holistically".

@MartinRandall Surprisingly, colleges are not places of public accommodation as defined by Title II of the Civil Rights Act.

@ForrestTaylor today I learned.

@MartinRandall Yup. The original Civil Rights Act of 1964 does not actually mention education at all, this was amended in the Education Amendments of 1972, which is where we get "Title IX": "No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance." Under the CRA, colleges are free to discriminate on the basis of race as explicitly as they wish!

@ForrestTaylor @MartinRandall You're both wrong. Colleges are not covered by Title II, but they are prohibited from discriminating on race by Title VI of the CRA. The allegation in the affirmative action case at the Supreme Court right now is that Harvard violated Title VI.

Also, Title IX of the Education Amendments of 1972 is not an amendment to the CRA.

@RiverBellamy You are right, my bad. In any case, this market is only supposed to be about places of public accommodation as defined in Title II. I made this market in response to some people fearmongering about the SC being likely to allow all discrimination at any business due to 303 Creative LLC vs. Elenis. Here's your reward for correcting me! https://manifold.markets/link/wiULEFZz
