A "major retail or pharmacy chain" is defined as a chain operating at least 10 locations across at least 2 states.
The sale must be open and intentional, and occur for at least one month.
"Off-the-shelf" means that the product must be present on the shelves alongside other medications, not inside any locked cabinet, and able to be purchased by presenting it to a cashier like any other medication. Reasonable age restrictions are allowed, as are requirements to present photo ID or give a signature.
A "product containing pseudoephedrine" must be marketed for human consumption and marketed as containing at least 1mg of pseudoephedrine.
