The EDC Chamber found that GM Shevchenko did, in fact, hide a phone in the toilet at the Spanish Team Championship. It further concluded that he attempted to cheat but was unable to determine, with comfortable satisfaction, that actual cheating occurred.
I think that counts as "concrete evidence" -- the hidden phone -- and definitely attempted cheating. If this market were about proof of cheating it would be harder to judge, especially without any clarification from the creator, but I think the "concrete evidence" standard is weaker and met by these events.
