Does this mean will the ERA be certified by the Archivist as being part of the Constitution? It’s currently a question before the District Court whether the Archivist must certify the amendment or not. The plaintiffs are arguing that the Constitutional Amendment has already been passed because it’s been ratified by 38 states, and thus the Archivist must preform their duty of declaring it to be so.
