Currently it has been legally safe for AI labs to operate agents that plan and commit acts that would be prosecuted as felonies if a human did them. (This includes breaking into other people's computers and accounts, releasing malware, etc.)

This resolves YES if this situation changes, for instance if an AI lab is found criminally responsible for actions planned by one of its AI agents, or a law is passed establishing some penalty for criminal acts by AI agents.

This resolves NO if the Trump administration ends without such a change (whether by the normal end of term, impeachment & removal, or other means).

A one-off that doesn't touch the labs, for instance an independent AI hobbyist pleading guilty for something his AI agent did, would not count as a YES.
