Is that even possible? My understanding is that an executive order can just have orders for federal offices. To restrict you it would require a law.

Executive orders are based on laws that are already on the books. Like this one is based a lot in the Defense Production Act, and presidents can sign orders that tell agencies to do things within the boundaries of those laws. So Biden's order could restrict an AI under a pre-existing law.
