According to a report from the Guardian (Bekiempis, 2023), Bankman-defend Fried's team intends to use the "advice of counsel" defense, which implies that he was unaware of any misconduct because his attorneys failed to inform him of such activities. Testifying could undercut this defense if this is their legal strategy because it could expose him to cross-examination and issues regarding his knowledge and intent. When on the stand, the prosecution may cross-examine Bankman-Fried if he were to testify to interrogate him about his behavior, financial choices, and knowledge of any suspected wrongdoing.
