Some definition - "serious crash" means a crash that causes either a hospitalization or death. By "fully automated vehicle" I mean a vehicle that is equipped with a Level 3 or above ADS and the ADS is engaged at the time - e.g. Waymo, Cruise or automated truck--not Tesla. The crash has to be caused by the ADS for it to pay. Ok what do you think?

Seems unlikely for Waymo/Cruise (if they still ran) to be at-fault in a crash. They have faster reaction times than any human. What they do tend to do though is indirectly create crashes. For example, hard braking results in a driver behind crashing into them at-fault. Or if they're clearing an intersection and see a fast-approaching speeding driver they tend to slam on the brakes too, deer-in-headlights style, resulting in getting T-boned, but again, speeding human driver at fault legally speaking.
