Resolves YES if an increase to the top marginal tax rate on long term capital gains (currently 20%) is signed into law in 2023, otherwise NO.
The tax raise does not have to be effective in 2023, as long as it is signed into law in 2023. The net investment income tax will have no bearing on the resolution of this question.
