Judge finds Donald Trump's appeal in E. Jean Carroll case 'frivolous'

A U.S. judge on Friday ruled that former President Donald Trump had filed a "frivolous" appeal of his decision not to dismiss the first of writer E. Jean Carroll's two defamation lawsuits stemming from her claim that he raped her.

@AliceRyhl This is a rejected appeal of a dismissal of a counterclaim by trump, so not strictly a failure of an appeal if this initial verdict.

That being said, the July 19th ruling seems to be a failure of appeal as well.

To my knowledge there is still ongoing litigation of the expanded defamation lawsuit by Carrol but no appeals of the initial verdict?

What if the removal of the time bar for the battery claim is ruled unconstitutional or if the award of damages is reduced?

@NiallWeaver I’ll define success as anything that measurably reduces the damages or liability. The battery charge being removed entirely would also count.
