The FTC has implemented a new rule banning non-compete agreements: https://www.ftc.gov/news-events/news/press-releases/2024/04/ftc-announces-rule-banning-noncompetes

This question will resolve to YES if a court enjoins the rule nationwide by the end of 2024. An injunction with more limited scope (limited to enforcement on one company, in one industry, or in one jurisdiction, for example) will not qualify.

Edit: to clarify the above, a temporary restraining order or preliminary injunction will satisfy these requirements, as long as it is nationwide.

I may have to use my discretion to resolve this market and I will not trade in it.
