A 2 1/2-year-old legal fight led by the National Horsemen's Benevolent and Protective Association (NHBPA) is trying to overturn the Horseracing Integrity and Safety Act (HISA) based on alleged constitutional flaws. The case is in its second go-round before the United States Court of Appeals for the Fifth Circuit in New Orleans, which declared a previous version of HISA unconstitutional in 2022. The National NHBPA, 12 of its affiliates, and a number of Texas-based racetrack entities, plus the state of Texas itself and its racing commission, are the plaintiffs/appellants. The HISA Authority, the Federal Trade Commission (FTC), and officials from each organization are the defendants/appellees.

Once again thanks for the emails and super excited about this project.

Feedback:

  • If there are only 2 possible options then it is usually best to create a YES/NO question and you would frame it as: "Will the Fifth Circuit rule in favor of HISA?" And then buying NO would imply you are voting on the opponents. That said, perhaps you do want "other" if there are other possible outcomes I am unaware of?

  • This market does work fine though! It can just be a bit confusing why there is an "other" and imo the graph looks worse. It is also a free response market, which means users can add their own answers for others to bet on, which may not be what you want. (But maybe it is? I'm not familiar enough with the question!)

  • If you do choose to create it as a YES/NO market. You can either N/A this one, or just leave it open and have two.
