EPA's chrysotile asbestos ban overturned by the end of 2025

Background The EPA announced a comprehensive ban on chrysotile asbestos on March 18, 2024, marking the first rule finalized under the 2016 amendments to the Toxic Substances Control Act (TSCA). Chrysotile asbestos is the only known form of asbestos still imported into the U.S., primarily used in the chlor-alkali industry, automotive brakes and linings, and other industrial products. The ban includes a two-year phase-out period for the chlor-alkali industry and a 180-day phase-out for other uses.

Resolution Criteria This market will resolve YES if any of the following occur before December 31, 2025:

  • A U.S. court issues a ruling that overturns the EPA's chrysotile asbestos ban

  • A U.S. court issues a stay on the implementation of the ban

  • The federal government (including the EPA) formally walks back or substantially modifies the ban in a way that allows continued use of chrysotile asbestos in previously banned applications

The market will resolve NO if none of the above occur before the end of 2025.
