The state of Florida threatened local TV stations with prosecution in 2024 over a campaign advertisement for Amendment 4. A recent executive order has, for all intents and purposes, removed the veneer of independence from independent agencies, and gives Trump control over their decisions and operations.
Brendan Carr, Trump's pick for the FCC, wrote the section on the agency for Project 2025. He mostly writes about using it to target China and axing regulations, but Trump may have additional plans on how to use the agency.
This question resolves YES if the FCC announces charges, threatens to charge, or otherwise brings threat of prosecution to any entity over a TV or Radio campaign advertisment before the midterms. The threat of prosecution does not necessarily need to be aimed at stations broadcasting the advertisements, though this is probably the most likely scenario if the FCC were to become involved. This applies to local, state-wide, federal, and ballot initiative campaigns. Phone and web campaigns do not apply.
