Update: being free to physically move as he likes within a foreign country, even without a passport and while having a trial prepared after arrest and release, counts as free.
I think this follows based on the existing definition.
However if he uses confined pretrial or during it, that would count as nonfree
@Ernie based on this comment, I'm resolving NO since afaik, his status is "free to move around in south korea, but passport has been taken and he can't leave". Please let me know information I need to know, and I am open to unresolving if there is reason to, to make things fair.
