@NicoDelon There has been an open grand jury in Delaware hearing testimony on these charges for months. He hasn't even reached an agreement on one of the charges yet, so that would imply he was indicted, no?
@NicoDelon They could have voted this morning or last week under seal, we wouldn't know until it was unsealed. Why wouldn't they have the grand jury they had in session just vote before making any deal? I am sure they were leaning too hard on the presidents son to make a deal before being indicted, but maybe??
@NicoDelon I may be wrong, but methinks you've been quick to bet heavy on these and you might lose a lot of money when people realize there's a guilty plea ≠ an indictment.
For Trump, the word 'indictment' was in bold, flashing, neon letters everywhere. Somehow here no one is talking about an indictment, only about a guilty plea.
@NicoDelon But wouldn't that be because Trump didn't make a deal to plead guilty, which he presumably could have been offered when his attorneys were invited to DoJ prior to indictment.
@BTE Yes. He could have avoided an indictment with a deal. That's exactly what Biden seems to have done. Ergo, presumably no indictment.
@NicoDelon Not sure how they could have a still unresolved charge for a firearm felony unless it was indicted though?
@NicoDelon For instance, I think that none of the guilty pleas in FTX/Alameda involved an indictment. The government only needs to have a strong enough case for the deal to make sense. At no point does there need to be an indictment.

Those do not, as a general rule, require entry of a plea. I'd be shocked if DOJ entered into a diversion agreement without Biden waiving indictment.
