@KevinBlaw not a lawyer, but Comey’s team already (a week ago) filed for dismissal based on both selective and vindictive prosecution right? They didn’t have to wait until 20th November.
He also argued that Trump’s dropping of Halligan in when his former USA refused to indict was improper and this Halligan’s signed indictment was invalid (other than being vague and weak)
@Pjfkh https://www.nysun.com/article/judge-involved-in-early-stages-of-comey-criminal-case-denounces-government-misconduct-in-setback-for-prosecutors timing is getting tight, but judge clearly thinks the govt went very wrong here.
@strutheo judge called out two misstatements of law to the grand jury by their legal advisor (the insurance lawyer “prosecutor” with no criminal experience that Trump dropped in when the professionals refused to bring the case). One of which was apparently gross misconduct (redacted but seems to suggest that the insurance lawyer misled the grand jury about the fundamental “presumption of innocence”, and diverted grand jury questions to Comey at trial!!!). Second one: the insurance lawyer suggested there was evidence that wasn’t being presented at grand jury but would be at trial…again misconduct.
This is such a BS case. Also a chance that government violated attorney client privilege based on a previous case.
@Pjfkh after the argument today, I feel like there is a small chance we get something by month’s end.
