Clarification requested : if they submit the paperwork, but it arrives late, what is the resolution ?

(ie they are in fact suing you, but because it was late it’ll be thrown out by default)

If they’re suing us but the court throws it out because it arrived too late resolves to No

If they sue us in time but it arrives too late but the court is fine with that because it was submitted in time and doesn’t listen to us saying “but it arrived too late” resolved to Yes
