Apple is considered a "gatekeeper" according to the Digital Markets Act. That means they need to open up until 6 March 2024.

Resolves YES if there is an alternative app to Apple's AppStore which is as easy to install and use. E.g. no need to know about IPA files.

Resolves NO in April.

Reducing the availability of an app store EU countries is possible and would still resolve to YES.

It's April in the EU and it looks like a NO. Did I miss anything?

What if Apple opens it up but there’s no third party marketplace launched? It’s been open for over a week now and I don’t see any third party marketplace available.

@esusatyo Opening it up is not enough, so today it would be a NO. It seems Apple's fee deterrence seems to work so far.

bought Ṁ30 NO

@marktwse Thanks for the clarifications

Does this still resolve Yes if there is a non-Apple app store available only to users in the EU? (This might also apply to your NFC payment question.)

predicted YES

@ClaudineC Yes. Regional (non-) availability is nothing unusual. Thanks for the hint!

Kind of "the followup market" to this question already exists:
