Why legislate when you can let the executive do it and take all the heat?

@MartinRandall My (possibly incorrect) understanding is that the limit is statutory and cannot be raised by the executive alone. What the FDIC did recently was invoke the "systemic risk" exception, and they could invoke that quite often, especially for larger banks, but probably not for literally every bank failure and especially the small community banks.

@MartinRandall For a thorny, separation-of-powers issue like that it's likely the courts would let somebody sue, like how they let states sue for immigration stuff.
