Will the Washington Millionaires' Tax hold up?

In March 2026, Washington state passed a law taxing wage earnings above $1 million / year, starting in tax year 2028 with payments due in 2029. There is substantial uncertainty about whether the state Supreme Court will find it constitutional, and of course it's controversial on the merits.


This market is about whether that tax will hold up. I expect to operationalize this as "does revenue from this tax in fact get collected in 2029".

  • If revenue is collected but there's an in-flight court case that might result in a return of that revenue, I will probably extend the close date.

  • If at market close it looks to me like the tax is smoothly humming along collecting revenue without challenge, I'll probably resolve YES despite the theoretical possibility someone could still sue and win.

  • If the law gets repealed, resolves NO. May resolve PROB if it gets reworked somehow, depending on my subjective assessment of similarity to the current law, but a full repeal is NO even if an identical tax gets passed later.
