Further technicality to get ahead of: if it goes to the confirmation vote, that is the vote that counts. There is no 60-vote filibuster for senate confirmations but there is a possibility that a nomination can fail on a procedural vote such as cloture nonetheless. In this case, any vote of the whole senate that scuttles the nomination will count. If the nomination dies in committee, it is NO regardless, unless there is a vote on the floor of the senate to revive the nomination. Basically anything that is the last vote on the senate floor on the nomination counts.
