Background
Temu is a rapidly growing e-commerce marketplace launched in September 2022. Its EU operations are legally administered by Whaleco Technology Limited, an Irish-incorporated subsidiary, while its ultimate parent company is PDD Holdings Inc. (listed on NASDAQ under the ticker "PDD").
Despite capturing significant market share in Europe, Temu faces heavy headwinds. These include regulatory actions by European regulators under the Digital Services Act (DSA)—under which Temu is designated a Very Large Online Platform (VLOP)—and proposals by EU authorities to eliminate tax exemptions (such as the de minimis customs duty loop) on cheap imports. This market tracks whether these combined regulatory, legal, and operational costs push the platform's European entity into formal bankruptcy or insolvency before 2028.
