I live in New Mexico. I got divorced in 2022. At the time my co-parent claimed a self-employed income of about $100 per month. I paid a little over $2,000 in alimony every month for 4 years. In their 2025 tax return, they claimed a self-employed income of about $300 per month. The alimony payments have come to an end, so naturally they want to recalculate child support. I argue that they are under-employed, so an income should be imputed to them for the purpose of calculating child support. I'm wondering how likely this is to succeed.
If an income is imputed to them for the purpose of calculating child support either by their agreement or by court order before the end of 2027, then this market resolves to YES. Otherwise, NO.
