New York has filed a lawsuit against JBS, the world's largest meatpacker, accusing the company of greenwashing. The lawsuit alleges that JBS has been making deceptive statements about its climate goals.

The New York Attorney General, Letitia James, highlighted instances where JBS made claims about net zero emissions on beef production by ambitious target dates but no actual evidence of progress or plans.

Meanwhile the company is expanding beef production, and in so doing contributing to massive deforestation and methane emissions in Ireland and Brazil. The lawsuit aims to hold JBS accountable for these false or misleading statements and seeks penalties for violating consumer protection laws.

New York has jurisdiction because JBS is a publicly traded company.

JBS has refuted these allegations.

Shutting it down since no one has bet, until I reformulate

Out of court settlements (without admitting fault, etc.) are common. How will this question resolve if that happens?

@DanHomerick I’ve been pondering that. Greenwashing is a market manipulation, eg an attempt to trade falsely on reputation.

An out of court settlement could be a YES if it involves JBL admitting their past claims were made in bad faith, or a change in company practices that credibly result in making good on those claims.

An out of court settlement β€œfor an undisclosed sum” and without admitting fault would not be a NO.

@DanHomerick any further suggestions? I will update the main description when this question is resolved.

@BlueDragon I don't have any good suggestions, no. I think out of court settlement with both parties claiming to have won is the most likely outcome.

I don't think I'm going to trade on this one partly because of that ambiguity, but mostly because I have no clue about either the facts of the case or the laws involved.

@DanHomerick Well thanks for stopping by!

If both sides claim credit and it’s impossible to draw a fact-based conclusion about who is right, this will resolve N/A

The facts in the case and pertinent laws are summarized in the links. I’ll see if I can pull more out for folks interested when I have time.
