18 U.S.C. § 922(n) states:
> It shall be unlawful for any person who is under indictment for a crime punishable by imprisonment for a term exceeding one year to ship or transport in interstate or foreign commerce any firearm or ammunition or receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce.
The key elements for this to resolve YES:
- Trump or someone who interacted with Trump is charged with a crime AND
- The charge relates to Trump handling, coming into posession of, or otherwise interacting with a firearm AND
- The charge is for activity that is illegal specifically because Trump is under indictment AND
- This happens before Jan 1 2026
Otherwise this will resolve NO.
I will also resolve this NO if at some point before 2026 Trump is no longer under indictment and there are no indications that a firearms-stuff-while-under-indictment charge is likely to be brought.
Other notes:
- the charge does not necessarily need to be under 18 U.S.C. § 922
- the charge does not have to be about anything that happened on September 25, 2023
