Resolution criteria
The market resolves YES if New Mexico's Department of Health confirms that the medical psilocybin program is operational and accepting initial patients by April 20, 2027. Resolution will be based on official announcements from the New Mexico Department of Health or verified reporting from state health officials. The program must be accepting patients for supervised psilocybin-assisted therapy in approved clinical settings to count as "launched."
Background
Governor Michelle Lujan Grisham signed the Medical Psilocybin Act (Senate Bill 219) into law in April 2025. New Mexico is the first state in the U.S. to approve a medical psilocybin program through legislation, while Oregon and Colorado established theirs by ballot initiatives. The program is set to be fully implemented by December 31, 2027, but the state now plans to have the program running by December 2026, approximately one year ahead of the statutory deadline. The program calls for psilocybin to be administered to patients by a New Mexico-licensed health care provider in an approved clinical setting.
Considerations
Experts have noted that achieving the accelerated timeline will require significant dedication to establish rules and regulations, and the process of training facilitators, prescribers, and establishing vetted facilities in every New Mexican municipality is paramount. A state senator called the December 2026 goal "aspirational," emphasizing that it must be achieved safely with proper provider and facilitator training and all other important program parameters met.
